You agree to utilize this platform solely for legitimate purposes. We implement defensive security layers and server-hardening protocols to mitigate malicious activity. You are strictly prohibited from: Executing automated scripts, bots, or scrapers that interfere with site performance. Attempting to circumvent our server-hardening measures or rate-limiting configurations. Disrupting the functional integrity of our communication scripts, including the WhatsApp redirection logic. 3. Limitation of Liability & Technical Indemnity. The technical infrastructure of this website is provided "as is." You acknowledge that: No Technical Guarantee: While we implement rigorous security measures, we do not warrant that the website is impenetrable or free from latent vulnerabilities. Script Performance: We are not liable for the failure of third-party integrations (e.g., WhatsApp) or the accurate transmission of contextual metadata (e.g., page paths) appended by our tracking scripts. Consequential Loss: Under no circumstances shall we be held liable for any data loss, server downtime, or indirect financial repercussions resulting from the use or inability to use our technical configurations. 4. Communication & External Platforms. Our site facilitates direct engagement via WhatsApp. Data Handoff: By utilizing our WhatsApp links, you acknowledge that our script modifies the communication string to include your current page location for contextual utility. Third-Party Terms: Once redirected, your interactions are governed by the terms and privacy protocols of the external platform (WhatsApp/Meta). We disclaim all responsibility for data handling once it leaves our local environment. 5. Intellectual Property. The proprietary scripts, server configurations, and content on this website are the intellectual property of Riaan Wessels and are protected under South African and international copyright statutes. Unauthorized reproduction, reverse engineering, or redistribution of our custom tracking or hardening logic is strictly prohibited. 6. Privacy & POPIA Compliance. Your interaction with this site is governed by our Privacy Policy. In accordance with the Protection of Personal Information Act (POPIA), we utilize minimal online identifiers (such as anonymized Client IDs) to distinguish human traffic from bot activity. We do not maintain persistent databases of your browsing history. 7. Statutory Disclosures (ECTA). We reserve the right to modify these terms unilaterally to reflect technological advancements or legislative mandates. 8. Governing Law. These terms are governed by the laws of the Republic of South Africa. You hereby submit to the exclusive jurisdiction of the South African courts for the resolution of any disputes arising from these terms. 8. Hosting Fees, Migration, and Support Conditions 8.1. Prepaid Hosting Fees (Non-Refundable). All hosting services are billed and payable in advance for the full agreed term. Once the hosting service has been provisioned and activated, all fees are strictly non-refundable. This applies regardless of usage, early termination, or migration to another provider. 8.2. Client-Initiated Migration. Clients may request to migrate their website, email, or domain services away from our infrastructure at any time. Such migration constitutes a separate, client-initiated service and is not included in any hosting or maintenance fees. 8.3. Migration Fees. All work related to migration is billable. This includes, but is not limited to:
-Website migration and restoration
- Email account setup, export, and import
- DNS updates and propagation management
- Coordination with third-party providers
- Troubleshooting access, configuration, or compatibility issues.
Migration work is billed at a standard rate R350/hour or as a fixed fee where agreed in advance. 8.4. Third-Party Dependencies and Delays. Where migration or support is dependent on third-party providers, client-supplied access, or external systems, any delays, repeated work, or additional time required will be billable. We are not responsible for delays caused by incomplete information, restricted access, or third-party constraints. 8.5. Access and Cooperation Requirement. Support and troubleshooting services require sufficient access to relevant systems or the provision of verifiable diagnostic information. Where access is refused or necessary information is not provided, we reserve the right to suspend troubleshooting and no obligation to resolve the issue will apply. 8.6. Unverifiable Issues. Issues that cannot be reproduced, observed, or validated through direct access or diagnostic data fall outside the scope of support. Time spent attempting to investigate such issues, where undertaken, will be billable. 8.7. No Obligation to Support External Environments. Once services are migrated away from our infrastructure, we hold no responsibility for ongoing support, performance, or functionality in the new hosting environment unless explicitly agreed in writing. 9. Client-Side Environment and Connectivity. 9.1. Scope of Responsibility. Our responsibility is limited to ensuring that hosted services are correctly configured, operational, and publicly accessible via the internet. We do not guarantee accessibility from any specific device, network, or location. 9.2. Client-Side Environment. The client is solely responsible for the configuration and operation of their own devices, browsers, networks, and internet connections. This includes, but is not limited to:
-DNS settings
-Browser configuration and extensions
-Operating system settings
-VPN, proxy, or private relay services
-Local network or ISP-related restrictions
9.3. Connectivity Issues. Where a website or service is confirmed to be live and accessible from external networks, any inability to access such services from a specific device or network will be deemed a client-side issue and falls outside the scope of hosting support. 9.4. Optional Assistance. Assistance with client-side troubleshooting may be provided at our discretion and is billable. Such assistance requires either direct access to the affected device or the provision of verifiable diagnostic information. 9.5. Limitation of Liability. We are not liable for access issues caused by client devices, local network configurations, third-party software, or internet service providers.
